Hogan Lovells Secures Major Pro Bono Victory for Georgia Voting Rights Organizations, Extending Voter Registration Deadline for Georgia Runoff Election

New York, 4 May 2017 – Hogan Lovells, working with the Lawyers' Committee for Civil Rights Under Law secured a significant pro bono victory in federal court in Georgia, requiring state officient to re-open voter registration for the hotly contested runoff election in Georgia's 6th Congressional District. The decision, issued by the Honorable Timothy Batten, Sr., United States District Judge for the Northern District of Georgia, ensures that eligible voters can register up to May 21, 30 days before the election and cast their ballots in the June 20 runoff election, where Democratic candidate Jon Ossoff and Republican candidate Karen Handel are vying to replace former Rep. Tom Price.

Judge Batten granted a preliminary injunction, holding that the plaintiffs will likely prevail in their argument that the National Voter Registration Act of 1993 requires that voter registration remain open until 30 days before a federal election, and takes precedence over conflicting Georgia law that treated the runoff as a continuation of the April 18 special election. Per the order of the court, eligible individuals will have through May 21st to register and vote in the upcoming special election in the state.

Ira Feinberg handled the oral argument, along with Julie Houk of the Lawyers' Committee and Atlanta counsel, Bryan Sells. Jonathan Abram, Paul Wiley, and Emily Goldman assisted with the suit.

"It is very gratifying that the Court recognized that any administrative hurdles that election officials might face in extending the deadline pale in comparison to the harm incurred by disenfranchising thousands of eligible voters from this important runoff election," said Ira Feinberg.
